1. Seller identification
The Malmequer online store is operated as a sole trader, tax ID (NIF) 250903326, registered in Portugal. For any questions, contact us at geral@malmequer.pt.
2. Scope and acceptance
These terms and conditions govern the use of the malmequer.pt website and purchases made through it. By using this site or placing an order, you declare that you have read, understood, and fully accept these terms. We reserve the right to update these terms at any time; the version in force is the one published on the site at the time of purchase.
3. Products and prices
All prices shown include VAT at the legal rate in force in Portugal. Product images are illustrative and may show slight color variations from the actual product due to differences in screen calibration. Descriptions are as accurate as possible but do not replace an in-person assessment of the product.
Prices may change at any time without prior notice, but changes do not affect orders already confirmed.
4. Orders and contract
Submitting an order constitutes an offer to purchase. The sales contract is considered concluded when you receive the order confirmation email. We reserve the right to refuse or cancel orders in the event of an obvious pricing error, unavailability of stock, or suspected fraud.
Once confirmed, payment is processed immediately. If payment cannot be completed, the order will be automatically cancelled.
5. Payments
Payments are processed securely through Stripe. We accept credit card, debit card, MB Way, Multibanco, Apple Pay, Google Pay, Samsung Pay, Amazon Pay, and Link. Malmequer does not have access to your full card details — these are processed directly by Stripe, which is PCI DSS certified.
6. Shipping and delivery
Shipping conditions, delivery times, and costs are detailed on our Shipping and Returns page. Risk of loss or damage transfers to the customer at the moment of delivery.
7. Right of withdrawal
Under Portuguese Decree-Law no. 24/2014, the customer has the right to withdraw from the contract within 14 calendar days of receiving the product, without needing to state a reason. To exercise this right, contact us at geral@malmequer.pt or through our contact page.
Items must be returned in their original condition, unused, with all tags intact. See our full policy on the Shipping and Returns page.
8. Warranty and conformity
All products sold are covered by the legal conformity warranty under Portuguese Decree-Law no. 67/2003 (as amended by Decree-Law no. 84/2021), which sets a 3-year warranty period for goods purchased from January 1, 2022 onward. If the product shows a lack of conformity, the customer is entitled to repair, replacement, price reduction, or termination of the contract, as provided by law.
In the case of a defective or non-conforming product, return costs are covered by Malmequer.
9. Limitation of liability
Malmequer will not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use the site, including but not limited to delivery delays caused by carriers or force majeure.
The site is provided "as is". While we make every effort to keep the site operational, we do not guarantee it will be available uninterrupted or error-free.
10. User account
Access to certain features (such as order history) requires authentication. The customer is responsible for keeping their login credentials secure. Malmequer will not be liable for unauthorized access resulting from the customer's negligence in protecting their authentication details.
11. Intellectual property
All content on this site — including text, photographs, illustrations, logos, and design — is the property of Malmequer or its licensors and is protected by copyright and applicable intellectual property law. Reproduction, distribution, or commercial use without prior written authorization is prohibited.
12. Data protection
Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR) and applicable Portuguese law. For more information, see our Privacy Policy.
13. Dispute resolution
In the event of a consumer dispute, the customer may turn to the authorized Alternative Dispute Resolution (ADR) entity:

14. Governing law and jurisdiction
These terms are governed by Portuguese law. In the event of a dispute, the courts of the consumer's domicile have jurisdiction, as provided by applicable law.
